{"id":354,"date":"2017-12-06T11:23:07","date_gmt":"2017-12-06T11:23:07","guid":{"rendered":"https:\/\/hrbusinessmonitor.eu\/?p=354"},"modified":"2017-12-06T12:24:43","modified_gmt":"2017-12-06T12:24:43","slug":"new-law-on-consumer-protection-comes-into-force-on-07-december","status":"publish","type":"post","link":"https:\/\/hrbusinessmonitor.eu\/index.php\/2017\/12\/06\/new-law-on-consumer-protection-comes-into-force-on-07-december\/","title":{"rendered":"New Law on Consumer Protection Comes Into Force on 07 December"},"content":{"rendered":"<p><span lang=\"EN-US\"><span style=\"color: #000000; font-family: Calibri;\"><a href=\"http:\/\/vijesti.hrt.hr\/418986\/sutra-na-snagu-stupa-zakon-o-zabrani-nepostenim-trgovackim-praksama-u-lancu-opskrbe-hranom\">The law bans<\/a> unfair competition in food production, processing and distribution, and regulates subjects in all of the stages, including the primary producers, the wholesale buyers, the processing industry and the retail.<\/span><\/span><\/p>\n<p><span lang=\"EN-US\"><span style=\"color: #000000; font-family: Calibri;\">For instance, the law aims to prevent misuse of dominant position in negotiations and market relations, it sanctions imposition and transfer of costs, unfair charges for non-existent services, unjustified termination of contracts and other problems.<\/span><\/span><!--more--><\/p>\n<p><span lang=\"EN-US\"><span style=\"color: #000000; font-family: Calibri;\">It requires all retail chains with annual income of over Kn 100 million, and buyers and processing industries with annual income of more than Kn 50 million to align their contracts with the law by 31 March 2018, or they will be deemed invalid ex lege. Maximum fines have been raised from Kn 3.5 million to Kn 5 million for companies, and from Kn 1.5 to Kn 2.5 million for physical persons. The maximum penalty can be imposed if, for instance, the retailer sells the goods at a price lower than purchase price anywhere in the supply chain. Maximum payment period for fresh products was reduced from 60 to 30 days. <\/span><\/span><\/p>\n<p><span lang=\"EN-US\"><span style=\"font-family: Calibri;\"><span style=\"color: #000000;\">The law lists 24 examples of unfair practices known so far, including retailers or wholesales charging their suppliers in order to buy or market their products, various compensations, charges for new investments, market research etc. \u00a0<\/span><\/span><\/span><\/p>\n<p><span lang=\"EN-US\"><span style=\"color: #000000; font-family: Calibri;\">The Competition Agency will be in charge of implementation of the law, and it will have authority to conduct unannounced searches, temporarily seize objects, seal property and facilities, impose penalties and arrange reduction of penalties for collaborating witnesses. <\/span><\/span><\/p>\n<p><span lang=\"EN-US\"><span style=\"color: #000000; font-family: Calibri;\">\u00a0<\/span><\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>The law bans unfair competition in food production, processing and distribution, and regulates subjects in all of the stages, including the primary producers, the wholesale buyers, the processing industry and the retail.
